Introduction
TalentBurst, Inc. and its affiliates, including but not limited to, TalentBurst Healthcare & Life Sciences, Inc., TalentBurst Connect, Inc., TalentProcure, Inc. and TalentBurst Shared Services, LLC (collectively, “TalentBurst”, “we”, “us”, or “our”) is an award-winning provider of contingent workforce solutions, including, without limitation, temporary and permanent staffing services; employer of record, independent contractor validation, and agent of record services; managed services provider (“MSP”) services; and other related services (collectively, the “Services”) to Fortune 500 companies and other organizations in a variety of industries (collectively, our “Clients”).
This Privacy Notice For Employees and Job Applicants (the “Employee Privacy Notice”) applies to job applicants, our employees, and contingent workers placed on assignment with our Clients (whether as W-2 employees or independent contractors) (collectively, “Employees”) and provides a comprehensive description of our practices regarding how we collect, use, process, disclose, maintain and retain Personal Information (as defined below) in the job application and employment context. For the avoidance of doubt, our inclusion of independent contractors in the definition of Employee does not indicate or constitute an admission that said individuals are in fact employees as opposed to independent contractors. This Employee Privacy Notice is also intended to comply with the requirements of the California Consumer Privacy Act of 2018, as amended by the California Privacy Rights Act (collectively, “CCPA”), where applicable and indicated.
As used herein, “Personal Information” includes information that identifies, relates to, describes, or is reasonably capable of being associated with, or could reasonably be linked, directly or indirectly, with a particular person (or with a particular California resident or household as defined in the CCPA). Personal Information includes “personal data”, as such term is defined under applicable data privacy laws. Personal Information does not include publicly available, deidentified, or aggregated information or lawfully obtained, truthful information that is a matter of public concern.
Personal Information may include “Sensitive Personal Information,” which is a subset of Personal Information that includes data about financial account information and passwords, health information, Social Security or other national identification number, racial or ethnic origin, political opinions, religious beliefs, trade union membership, criminal convictions, biometric data, genetic data and precise geolocation data.
This Employee Privacy Notice does not apply to our collection, processing and use of Personal Information in a consumer or business-to-business situation or in connection with users’ interaction with our website. OUR ROLE IN DATA PROCESSING
To the extent the General Data Protection Regulation (“GDPR”), Regulation (EU) 2016/679, and the UK Data Protection Act 2018 (“DPA”) apply (collectively referred to in this Employee Privacy Notice as “EU or UK data protection laws”), the entity responsible for any collection and use (processing) of your Personal Information is TalentBurst, as the data controller. PERSONAL INFORMATION WE COLLECT AND HOW WE USE IT
We collect and process information from you for human resources, employment, and benefit administration purposes and where necessary to comply with local, state and federal legal obligations. We obtain the categories of Personal Information listed below directly from you during the job application process, the onboarding process and during the selection of your benefits, as applicable. We also may obtain your Personal Information in connection with conducting a post-offer pre-employment background check on you.
We will not collect additional categories of Personal Information or use the Personal Information collected for materially different, unrelated, or incompatible purposes without first providing you with an additional or updated notice.
The table below sets forth the categories of Personal Information we may collect and, for each category, the expected retention period, the purpose(s) for which we collect it and whether and to whom we may disclose it. TalentBurst does not sell the Personal Information we collect from our employees, prospective employees, and job applicants or share it with third parties for cross-context behavioral advertising. You are not legally required to provide this information but, for some of the information, if you fail to provide it, we would not be able to consider your employment.

Health or sexual orientation information. |
Health and safety information such as health conditions, if relevant to your employment, job restrictions, workplace accident and illness information, and health insurance policy information. We collect this information to maintain a safe workplace, assess your working capacity and make necessary accommodations, administer health and Worker’s Compensation programs, and comply with applicable laws. |

When you interact with our website, we may collect your internet or other electronic network activity information via trackers on the website, some of which may be considered a sale or sharing under the CCPA. However, we don’t sell/share Personal Information other than information collected through trackers on our website. To opt out, please visit Do Not Sell or Share My Personal Information. Any Personal Information you provide to a third party will be subject to that third party’s privacy notice and our use of the Personal Information we obtain from such third parties will be subject to this Employee and Applicant Privacy Notice. We do not collect all categories of Personal Information from each third party source.
HOW WE SHARE/DISCLOSE YOUR PERSONAL INFORMATION
TalentBurst does not sell or otherwise disclose your Personal Information to any third parties for any monetary or other valuable consideration (aside from the sale/share of data collected via trackers, as mentioned above).
As noted above, however, we may disclose your Personal Information to the following categories of recipients:
- Within TalentBurst. TalentBurst may disclose your Personal Information within our organization to fulfill the purposes described in this Employee and Applicant Privacy Notice, but in no event for marketing purposes. Within TalentBurst entities, access to, use of, and other processing of Personal Information will generally be limited to individuals who have a need to know the information for the purposes described in this Employee and Applicant Privacy Notice, which may include personnel from: Human Resources, IT, Compliance, Legal, Information Security, and Finance and Accounting. Most personnel within TalentBurst will have access to your business contact information, such as name, position, telephone number, work address, and email address. To the extent the EU or UK data protection laws apply, the legal basis for this sharing is our legitimate interest in carrying out our business and application process efficiently.
- Our Service Providers. Service Providers include but may not be limited to: (a) IT systems and support providers, account monitoring services, financial institutions, telecommunications providers, and insurance companies; (b) accountants, auditors, lawyers, and other outside professional advisors; (c) other third parties engaged to assist us in carrying out business, recruiting, or human resource activities; and (d) data verification services to ensure your data is accurate and to reduce errors. TalentBurst does not allow third party service providers to use or disclose your Personal Information except as necessary to perform services on our behalf or to comply with legal requirements. See section titled “Cross-Border Transfers” for information regarding the transfer of Personal Information to countries located outside of the European Economic Area (EEA) and the United Kingdom (UK).
- For Legal Purposes. TalentBurst may share personal information where we are legally required to do so, such as in response to court orders, subpoenas, governmental/regulatory bodies, law enforcement or legal process, including for national security purposes. We may share your information with our legal advisors or auditors to establish, protect, or exercise our legal rights or as required to enforce our terms of service or other contracts or to defend against legal claims or demands. We also share this information with third parties as necessary to: detect, investigate, prevent, or take action against illegal activities, fraud, or situations involving potential threats to the rights, property, or personal safety of any person; to comply with the requirements of any applicable law; or to comply with our legal obligations. To the extent the EU or UK data protection laws apply, the legal basis for this processing is compliance with the law or our legitimate interest in complying with non-EU data protection laws to which we are subject.
- In the Event of a Corporate Reorganization or with Business Investors. Your Personal Information may be disclosed to potential investors or buyers, and their advisors, auditors, and legal counsel in connection in the event that we enter into, or intend to enter into, a transaction that alters the structure of our business, such as a reorganization, merger, acquisition, sale, joint venture, assignment, consolidation, transfer, change of control or other disposition of all or any portion of our business, assets or stock, including bankruptcy or liquidation, with third parties, including the buyer or target (and their agents and advisors) for the purpose of facilitating and completing the transaction. We will also share Personal Information with third parties if we undergo a bankruptcy or liquidation, in the course of such proceedings. To the extent the EU or UK data protection laws apply, the legal basis for this is our legitimate interest in carrying out our business operations or, if required by law, consent.
- With Your Consent. Apart from the reasons identified above, we may request your permission to share your personal information for a specific purpose. We will notify you and request your consent before you provide the personal information or before the personal information you have already provided is shared for such purpose. You may revoke your consent at any time and may do so by contacting us via email at privacy@talentburst.com.

Cross-Border Transfers
With respect to employees located in the EU or UK, we collect Personal Information from the employee directly or our third party global payrolling vendor(s). To facilitate the transfer of Personal Information in compliance with the EU or UK data protection laws, we have taken appropriate safeguards to require that your Personal Information remains protected in accordance with such laws. These include implementing the European Commission’s Standard Contractual Clauses (and UK Addendum), as applicable, for transfers of Personal Information within TalentBurst or from our third party global payrolling vendors located in countries outside of the European Economic Area (EEA) and United Kingdom that have not been found by the European Union nor the United Kingdom Secretary of State to provide an adequate level of protection of Personal Information.
With respect to applicant data, we collect the data directly from the United States and so there is no cross-border transfer of Personal Information. However, we still apply reasonable safeguards to protect such Personal Information from unauthorized access or use, such as by implementing technical, administrative, and organizational measures and processing the Personal Information in compliance with the law and with the provisions of this Employee and Applicant Privacy Notice.
YOUR INFORMATION CHOICES AND RIGHTS
California Privacy Rights
If you are a resident of California, you have the following rights with respect to your Personal Information:
- The Right to Access/Know what Personal Information we have collected about you, including the categories of Personal Information, the categories of sources from which we collected Personal Information, the business or commercial purpose for collecting, selling, or sharing Personal Information (if applicable), the categories of third parties to whom we disclose Personal Information (if applicable), and the specific pieces of Personal Information we collected about you.
- The Right to Delete Personal Information that we collected from you, subject to certain exceptions.
- The Right to Correct inaccurate Personal Information that we maintain about you.
- The Right to Opt Out of Sale or Sharing, if we sell or share Personal Information.
- The Right to Opt Out of Automated Decision-Making Technology including “profiling”; however, we do not process Personal Information in a manner that gives rise to this right.
- The Right to Limit Our Use or Disclosure, if we use or disclose sensitive Personal Information for purposes other than those allowed by the CCPA and its regulations. However, we do not process sensitive Personal Information for such purposes without your consent. To the extent you have consented to such processing, such as the sharing of your race/ethnicity with prospective employers, you may revoke your consent at any time with effect moving forward by following the instructions below.
- The Right To Not Receive Discriminatory Treatment by us for the exercise of privacy rights conferred by the CCPA.
How to Exercise Your Rights
If you wish to exercise your privacy rights, you may submit a request via email to privacy@talentburst.com, by calling toll-free (855) 706-7801. To opt out of the sale/share of your information through cookies, please visit Do Not Sell or Share My Personal Information. If the browser or extension that you (or your authorized agent) are using supports Global Privacy Control (GPC) (see here for more information), you may utilize the GPC opt out preference signal to instruct us to not sell or share any of your personal information collected online. The GPC opt out preference signal will apply to the device, platform, or browser in which you utilize it. You can utilize the opt out preference signal by turning on the signal in your device, platform, or browser settings. Please note that you must opt out of each device and each browser.
For all such requests, you must provide us with your name, email address, phone number and mailing address. We may request additional information from you to help us confirm your identity. Failure to provide the necessary information may prevent us from processing your request. If you have requested that we correct your Personal Information, we may contact you to request additional information as wo what Personal Information you believe is inaccurate.
Only you, or a person that you authorize to act on your behalf may make a request related to your Personal Information. If you are an authorized agent making a request on behalf of another individual, you must provide us with signed documentation that you are authorized to act on behalf of that individual.
Upon receipt of your request to exercise your rights, we will acknowledge receipt within the time-period required by applicable law and provide you with information about the next steps in the process.
Other US States
If you reside in another state, you may have rights in connection with your personnel files under State labor and employment laws. Please contact privacy@talentburst.com to exercise your rights.
Rights of Individuals in the European Union and United Kingdom
Individuals who reside in the European Union and United Kingdom are entitled to certain rights under the GDPR and DPA, respectively. To the extent these laws apply to our processing of your Personal Information, you are entitled to the following rights:
- Right to Access. For any of the processing described above, you have the right to ask us for copies of your Personal Information subject to certain exceptions, which may include the management information exemption (data that we process for management forecasting or management planning about a business or other activity), or certain instances of ongoing or prior negotiations with the requestor, among others.
- Right to Rectification. For any of the processing described above, you have the right to ask us to rectify Personal Information you think is inaccurate or incomplete.
- Right to Erasure (to be Forgotten). You have the right to request erasure of your Personal Information that we are not obligated to keep in some cases (also known as the right to be forgotten). For example, you can request us to delete your Personal Information if: (i) we no longer need the data for the purpose it was collected for, (ii) we process the data based on your consent and you revoke your consent, such as the sharing of your race/ethnicity, or (iii) you object to our processing based on legitimate interest (and we do not have an overriding legitimate interest). We may not be able to immediately erase your Personal Information if we have a lawful reason or a legal or contractual obligation to retain the Personal Information or continue the processing.
- Right to Restrict Processing. For any of the processing described above, if you believe that your Personal Information is inaccurate, that our processing is unlawful, or that we do not need your Personal Information for a specific purpose, you have the right to request that we restrict the processing of this Personal Information. You also may request that we stop processing your Personal Information while we assess your request.
- Right to Object. You have the right to object to our processing of your Personal Information when the legal basis for the processing is pursuant to our legitimate interests by referencing your personal circumstances. For example, you may exercise your right to object when we process your Personal Information for purposes of carrying out efficient business processes. If you object to our processing, you may also request us to restrict processing of your Personal Information while we make our assessment.
- Right to Data Portability. You have the right to ask that we transfer the Personal Information you gave us from one organization to another or give it to you. However, this right only applies when: (i) you have provided your Personal Information to us; (ii) the legal basis for the processing is your consent or for the performance of a contract, such as when we administer payroll or benefits; or (iii) the processing is carried out by automated means.
- Right to Lodge a Complaint. If you are located in the UK, you have the right to lodge a complaint with the Information Commissioner’s Office at: https://ico.org.uk/make-a-complaint/data-protection-complaints/data-protection-complaints/y or accessicoinformation@ico.org.uk at their helpline on 0303 123 1113. If you are located in the EU, you have the right to lodge a complaint with the relevant Supervisory Authority.

DATA RETENTION
If you are an employee, we retain your information in accordance with our data retention policies and applicable law.
If you are an applicant, we retain your Personal Information subject to exceptions as set forth below (i) for the duration of the application process, (ii) until we receive a valid request to delete the information, (iii) until we no longer need the information to fulfill the purposes for which we collected it, or (iv) until the information is no longer needed for a service provider or contractor’s operational purpose(s).
We use the following criteria to determine whether it remains reasonably necessary to retain your Personal Information for such purposes or a service provider or contractor’s operational purpose(s): (i) whether there is a retention period required by statute or regulations; (ii) the existence of actual or threatened litigation for which we are required to preserve the information; (iii) the statutes of limitations for potential legal claims; and (iv) generally accepted best practices in our industry, including in relation to the safety and security of our properties and assets. When we determine that it is no longer reasonably necessary to retain your Personal Information for one or more disclosed operational purposes based on the above criteria, we will delete or anonymize your Personal Information.
CHANGES TO THIS PRIVACY NOTICE
We may amend this Employee and Applicant Privacy Notice at any time in our sole discretion. If we do, we will post the changes to this page and will indicate the date the changes go into effect. We encourage you to periodically review this Employee Privacy Notice and to stay informed. If we make changes that materially affect your privacy rights, we will notify you by prominent posting on the Website and/or via email, and obtain your consent, if required.
