TalentBurst Privacy Notice

Introduction

This Privacy Notice: (i) describes how TalentBurst, Inc. and its affiliates, including but not limited to, TalentBurst Healthcare & Life Sciences, Inc., TalentBurst Connect, Inc., TalentProcure, Inc. and TalentBurst Shared Services, LLC (collectively, “TalentBurst”, “we”, “us”, or “our”) collect, use, process, disclose, maintain, and retain Personal Information when you visit and interact with us online through our website (www.talentburst.com), or any other TalentBurst-branded or supported websites (including without limitation, www.talentprocure.com, www.talentburst.health, www.talentreferplus.com, and www.talentburstconnect.com), web pages, mobile application or mobile websites (collectively, the “Website”), or by phone, videoconference, email, text or in person, when you avail yourself of or receive our Services (as defined below); and (ii) explains the choices and rights available to you.

TalentBurst is an award-winning provider of contingent workforce and staff augmentation solutions, including, without limitation, temporary and permanent placement staffing services; employer of record, independent contractor validation, and agent of record services; managed services provider (“MSP”) services; and other related services (collectively, the “Services”) to Fortune 500 companies and other organizations in a variety of industries (collectively, our “Clients”).

As used herein, “Personal Information” includes information that identifies, relates to, describes, or is reasonably capable of being associated with, or could reasonably be linked, directly or indirectly, with a particular person (or with a particular California resident or household as defined in the CCPA). Personal Information includes “personal data,” as such term is defined under applicable data privacy laws. Personal Information does not include publicly available, deidentified, or aggregated information or lawfully obtained, truthful information that is a matter of public concern.

Personal Information may include “Sensitive Personal Information,” which is a subset of Personal Information that includes data about financial account information and passwords, health information, Social Security or other national identification number, racial or ethnic origin, political opinions, religious beliefs, trade union membership, criminal convictions, biometric data, genetic data and precise geolocation data.

Please note that once you have been identified for a specific position with us or a Client, or you are a TalentBurst employee, consultant, or independent contractor, you may be subject to and should review the TalentBurst Privacy Notice for Employees and Job Applicants, which describes, among other things, additional Personal Information that we will obtain from you and third parties.

PERSONAL INFORMATION WE COLLECT, FOR WHAT PURPOSES, HOW WE USE IT AND HOW LONG WE RETAIN IT

We collect, store, process, and use Personal Information for business and commercial purposes as described below. We collect this information: (i) from you, such as when you contact us to register with the Website; (ii) from third parties, such as Clients; websites and social media platforms, such as job boards and professional network sites and other platforms where you post information; individuals who refer you to a particular job opportunity; public government filings; and industry publications; or (iii) by automated means when you visit the Website.

We only use your Personal Information for the purposes for which we collected it, unless we reasonably consider that we need to use it for another reason and that reason is compatible with the original purpose.

We also use the Personal Information we collect to comply with the law, to efficiently maintain our business, and for other limited circumstances as described below.

  1. If You Contact Us (as a Job Applicant or Otherwise), Refer a Friend for a Potential Job Opportunity or Subscribe to Our Newsletter:

We collect Personal Information when you:

  • Contact Us: When you contact us with regard to potential job opportunities or with general inquiries, we collect, from you, your personal identifiers (name, email address, phone number, and general location), internet or other electronic network activity information (Source IP), professional or employment-related information (resume/CV, education and employment history, credentials, professional licenses, and job skills), audio and visual information (photos you provide to us or make publicly available on the internet), and any other information you choose to include in your correspondence. We use this Personal Information to respond to your questions or inquiries, troubleshoot where necessary, and address any topics you inquire about. We also use this information to provide and perform the Services, including to send you job listings, contact you about placement opportunities, or to identify new candidates or clients. We share your information with certain of our vendors, who facilitate your communication with us.

Inferences and Automation

When we use the Personal Information that we collect about you to match you with potential opportunities, we sometimes use the help of inferences we make, and automation technologies. We may also use these technologies to improve the quality of opportunities that we provide to you, or to improve the Services that we offer to both you and our Clients. We may utilize automation to help match you to potential job opportunities that we think would be a good fit for you and your skillset. However, we will not make any decision that would significantly affect you based solely on processing by automated means, such as whether to submit you for assignment to a Client or extend you a job offer. We include human intervention, including through quality control assessments, throughout the entire application and hiring process to make sure that you are not adversely affected by automation tools.

  • Refer a Friend: When referring a friend via our TalentReferPlus referral program, you must first obtain their consent to provide us with their Personal Information. When you refer a friend, we collect, from you, your personal identifiers (name, email address, and phone number). We also collect, from you, your friend’s personal identifiers (name, email address, and phone number) and their professional or employment-related information (job title and professional experience) and any other information you choose to include regarding their experience, which they have consented to you sharing with us. We use this information to assess and evaluate your friend’s suitability for the position to which you referred them and other positions with our Clients. We also use this information to determine whether and when you qualify for a potential referral bonus according to the terms and conditions of the TalentReferPlus referral program, which can be found here. We share your information and your friend’s information with our email and online contact vendors, who facilitate gathering the information to provide to TalentBurst for our use. We may also share your information and your friend’s information with our Clients for potential job placement with them.
  • Subscribe to TalentBurst’s Email Newsletter: When you subscribe to our email newsletter (which may include publications, alerts, announcements or similar communications), we collect from you your personal identifiers (name and email address), and contact preferences. We use this Personal Information to fulfill your request to receive email alerts with our company newsletter. We will share your identifiers (name and email address) with our email marketing provider to send you the marketing emails. To opt out of this sharing, please visit Do Not Sell or Share My Personal Information. You can unsubscribe from marketing emails at any time by clicking on the “unsubscribe” link in each email. Please note that we will continue to send you notifications necessary in connection with your receipt of the Services. Our communications contain tracking technologies, like pixels, to analyze whether a predefined action took place by a recipient, such as opening our communications and other engagement metrics such as timestamps, delivery status, the IP address of your computer, whether an email was forwarded, clicks within an email, as well as sender and recipient addresses. We use this information to send you additional email communications which may be of interest to you based on your interaction with our emails and/or website and to better adapt, personalize and distribute our communications. You can avoid downloading the pixel by rejecting the download of images in the email.
  1. If You Interact With Us Through SMS Messages/Text:

Consent to receive SMS Messages: If you consent, we may send you promotional, applicant, and employment-related SMS messages. By consenting to SMS messages, you agree to allow TalentBurst, with the assistance of its service providers, to contact you with regard to job applications or employment opportunities and other transactional messages at the phone number you provided, including by autodialed text messages even if your number is listed on a state or federal Do Not Call list. You understand and agree that SMS messages may be sent to you earlier and/or later than the time restrictions set by applicable state or federal law. Consent to receive SMS messages is not a condition of receipt of the Services or necessary to apply for a position, be hired or be placed on assignment with one of our Clients. You may opt-out at any time by replying “STOP” or texting “HELP” to get assistance to the number sending the message. After replying STOP, you may receive additional communications confirming that your request has been received and processed, and you may continue to receive SMS messages for a short period while TalentBurst processes your request. Standard message and data rates may apply. Message frequency may vary based on the texting program. You agree to update TalentBurst if you discontinue use of the telephone number you provided to us or obtain a different number. We do not transfer data regarding your consent for SMS communication to third party entities.

  1. If You Interact With Us on Social Media:

When you interact with our social media pages on social networking websites, such as Meta (i.e. Facebook), X (formerly Twitter), and LinkedIn (each a “Social Media Page” and collectively, the “Social Media Pages”), we collect, from you, your personal identifiers (first and last name) and visual information (photograph, such as a profile picture), as well as any information that you provide when interacting with our Social Media Pages (e.g., commenting, sharing, and rating). We collect basic engagement metrics which we use to tailor content and use it to improve user experience as set forth in this section.

We use this Personal Information to advertise our products, for events and invitations, and to communicate with users via the contribution and comment functions on our Social Media Pages. Because our Social Media Pages are publicly accessible, when you use them to interact with other users, for example by posting, leaving comments or liking or sharing posts, any Personal Information that you post in them or provide when registering can be viewed by others or used by them as they see fit. The content posted on our Social Media Pages or other public areas of social networking websites (each, a “Social Network” and, collectively, the “Social Networks”) can be deleted in the same way as other content that you have created. If at any time you want content posted to be deleted, please email your request to us at privacy@talentburst.com.

Please note that we do not control the use or storage of the information that you have posted to our Social Media Pages or any other Social Network. This information is collected and processed by the Social Networks for their own purposes, including marketing. Community Management

As noted above, we collect, from you, "likes", shares, messages and other interactions with the content on our Social Media Pages, to analyze and evaluate how our content is perceived, to learn from it, and to improve our marketing and communication efforts.

Page Insights

When you visit our Social Media Pages, the applicable Social Network records your IP address and other information about your usage behavior. The Social Network collects this information through trackers in the browser of your device or via the advertising ID (IDFA from Apple or GAID from Google), when you open the Social Network app through your mobile device (e.g., smartphone or tablet). The Social Network uses this information to provide us with statistical evaluations of the use of our Social Media Page. We receive this information directly from the Social Network, in the form of aggregated data and anonymous statistics regarding certain data points, such as: age; gender; city/country; device; inquiries from fans about other Social Media Pages; region and language settings of the users; proportion of men and women; the number of people reached; clicks on posts, "likes” and reactions; comments and shared content; and total video views. We use this information to analyze and improve the advertising campaigns we conduct through our Social Media Pages. We do not collect or process any other Personal Information in connection with Social Network “page insights” function. We do not retain this information independently. For information on data protection and the storage period on the Social Network in relation to its insights function, see the Social Network privacy policy linked above. It has been contractually agreed with the Social Network that the Social Network is responsible for providing you with information about the processing for page insights.

Information Processed Solely by Social Networks

We do not know how the Social Networks use Personal Information for their own purposes, how long the Personal Information is stored on the Social Network or whether the Social Network data is passed on to third parties. If you are currently logged in to a Social Network as a user, the Social Network automatically collects, through trackers on your device, your Social Network ID or a link between the Social Network ID and the advertising ID (IDFA from Apple or GAID from Google) when you open the Social Network app through your mobile device (e.g., smartphone or tablet). This enables the Social Network to understand that you have visited our Social Network fan page along with other Social Network pages that you have clicked on, whether you clicked on Social Network buttons integrated into websites that partner with the Social Network, and other online interactions that report user data to the Social Network. Based on this data, content or advertising tailored to you can be offered. You can find more information about the Personal Information collected by Social Networks, how it is used and how long it is stored by visiting the Social Network’s privacy policies, linked above. Additionally, Facebook, X, and LinkedIn process Personal Information in the United States where the laws may be less protective than in your country of residence. For example, in accordance with U.S. laws, in certain circumstances, courts, law enforcement agencies, regulatory agencies, or security authorities in other countries may be entitled to access your Personal Information.

  • If You Interact With Us Via the Website:

In addition to the Personal Information you provide directly to us, we also collect such information from you automatically as you access and use our Website via cookies, pixels, web beacons, and similar tracking technologies. This includes, but is not limited to, the following internet or other electronic network activity information: Internet Protocol (“IP”) address, unique device identifier, geolocation data, country, browser, browsing history, domain name, domain type, device operating system information, application version, language setting and information about your use of the Website. We do not collect Sensitive Personal Information in connection with your interaction with our Website.

We use essential, performance, marketing, and analytics cookies to collect your usage, device, and location information when you interact with the Website. We use this information to: (1) track you within the Website; (2) enhance user experience; (3) conduct analytics to improve the Website and Services; (4) prevent fraudulent use of the Website and Services; (5) diagnose and repair Website and Services errors, and, in cases of abuse, track and mitigate the abuse; (6) provide targeted advertising; and (7) capture and aggregate viewing and engagement metrics.

We also allow certain trusted partners to place trackers on our Website to collect information about how you interact with the Website and other websites you visit. We use HubSpot to analyze the data traffic on our Website and your behavior while using our Website, which includes page visits, mouse movements, clicks, text entered, and other details. We use this information to gain insights into user behavior on our Website, to enhance website functionality, and to deliver targeted advertisements. We do not combine the information collected through the use of HubSpot Analytics with Personal Information. We also use HubSpot to send our emails and to track the behavior of our email recipients. With the help of HubSpot’s conversion tracking, we can analyze whether a predefined action took place by an email recipient, such as opening our email, in order to better adapt and distribute our emails. For more information on HubSpot’s use and collection of Personal Information, please review its Privacy Policy. You can disable email tracking by disabling the display of images by default in your email program. To remove HubSpot’s tracking cookies from your browser, please visit HubSpot’s Cookie Policy. If you are a California resident and wish to opt out, please visit Do Not Sell or Share My Personal Information.

In general, you can also disable cookies by setting your browser to refuse cookies or indicate when a cookie is being sent. Please note, if you opt out of these trackers, your opt-out will be specific to the web browser, app, or device from which you accessed the opt-out. If you use multiple devices or web browsers, you will need to opt out of each browser or device that you use.

We aggregate the data we collect for benchmarking purposes and for internal analytics. We maintain and use this data in deidentified form. We will not attempt to reidentify the data unless it is necessary to determine whether our deidentification processes satisfy applicable data protection laws. If TalentBurst shares any aggregate, deidentified data with our service providers, our agreements with them also prohibit them from attempting to re-identify the data.

TalentBurst may also use your Personal Information collected for the above purposes to efficiently maintain our business, to comply with the law, and for other limited circumstances as described below in the section titled HOW WE SHARE OR DISCLOSE YOUR INFORMATION.

HOW LONG WE RETAIN PERSONAL INFORMATION

We use the following criteria to determine whether it remains reasonably necessary to retain your Personal Information for one or more disclosed operational purpose, or a service providers operational purpose(s): (i) whether there is a retention period required by law, statute or regulation; (ii) the existence of actual or threatened litigation for which we are required to preserve the information; (iii) the statutes of limitations for potential legal claims; and (iv) generally accepted best practices in our industry. When we determine that it is no longer reasonably necessary to retain your Personal Information for one or more disclosed operational purposes based on the above criteria, we will delete your Personal Information.

HOW WE SHARE or DISCLOSE YOUR PERSONAL INFORMATION

General Sharing

TalentBurst shares or discloses Personal Information as follows:

  • Within TalentBurst. We share your Personal Information with our personnel across our organization, on a need-to-know basis, for the legitimate purpose of efficiently and effectively providing the Services (i.e., to match you to potential job opportunities).
  • With Our Clients, MSPs, and Suppliers. With your consent, we disclose information such as your contact information and professional or employment-related information with our Clients, Managed Services Providers and suppliers so they can manage their contingent workforce programs, select workers to be assigned to work in their organizations and to our suppliers so they can assist in the provision of the Services.
  • In the Event of a Corporate Reorganization or to a Successor of All or Part of Our Business. In the event that we enter into, or intend to enter into, a transaction that alters the structure of our business, such as a reorganization, merger, acquisition, sale, joint venture, assignment, consolidation, transfer, change of control or other disposition of all or any portion of our business, assets or stock, we would share Personal Information with third parties, including the buyer or target (and their agents and advisors) for the purpose of facilitating and completing the transaction. We will also share Personal Information with third parties if we undergo a bankruptcy or liquidation, in the course of such proceedings.
  • Where Legally Required. We share Personal Information where we are legally required to do so, such as in response to court orders, subpoenas, governmental/regulatory bodies, law enforcement and legal process, including for national security purposes. We may share your Personal Information with our legal advisors or auditors to establish, protect, or exercise our legal rights or as required to enforce our terms of use or other contracts or to defend against legal claims or demands. We also share this information with third parties as necessary to: detect, investigate, prevent, or take action against illegal activities, fraud, or situations involving potential threats to the rights, property, or personal safety of any person; to comply with the requirements of any applicable law; or to comply with our legal obligations.
  • With Your Consent. Apart from the reasons identified above, we may request your permission to share your Personal Information for a specific purpose. We will notify you and request consent before you provide the Personal Information or before the Personal Information you have already provided is shared for such purpose. You may revoke your consent at any time by emailing us at privacy@talentburst.com.

All the above categories exclude text messaging originator opt-in data and consent; this information will not be shared with any third parties.

Sharing in the Last Twelve (12) Months

In the preceding twelve (12) months, TalentBurst has shared the following categories of Personal Information for a business purpose:

  • With Third Parties. We have shared your Personal Information, on a need-to-know basis, with third parties, including our agents, subcontractors, contractors, vendors, and service providers with whom we engage or collaborate to assist us in performing the Services, such as information technology providers and SaaS vendors (i.e., applicant tracking systems, customer relationship management systems, and marketing services vendors) and professional services providers (such as lawyers, bankers, insurers, auditors, and accountants). Only the information necessary to perform a specified business function will be or has been disclosed, and said third parties are subject to confidentiality requirements and are prohibited from using Personal Information for any purpose other than as described herein.
  • We share Personal Information to protect the rights, property, life, health, security or safety of TalentBurst, the Services, the Website and its users, our business partners or any third party or if we believe your actions are inconsistent with our Terms of Use or other applicable policies. In particular, we have disclosed your internet or other network activity information collected by cookies to our IT support vendors to detect security incidents, protect against malicious, deceptive, fraudulent, or illegal activity, and to identify and repair the Website, and to update, improve, and maintain the Website.

All the above categories exclude text messaging originator opt-in data and consent; this information will not be shared with any third parties.

 

Sale of Personal Information

In the preceding twelve (12) months, TalentBurst has shared your internet or other electronic network activity information collected via cookies and other tracking technologies with our data analytics providers as described in PERSONAL INFORMATION WE COLLECT, FOR WHAT PURPOSES, HOW WE USE IT, AND HOW LONG WE RETAIN IT. Such sharing may be deemed a sale or sharing under the CCPA. To opt out, please visit Do Not Sell or Share My Personal Information.

Processing in the United States

The Personal Information we obtain about you will be processed in the United States. However, you acknowledge that your Personal Information may be transferred to and processed in jurisdictions outside of your own in order for us to provide the Services. The data protection laws that apply to your Personal Information transferred to the United States or these other jurisdictions may not be as comprehensive or afford the same level of protection as those in your country of residence. We take steps, where required, to provide appropriate safeguards for such Personal Information, including, without limitation, standard data protection clauses adopted or approved by the European Commission.

DO NOT TRACK

We do not respond to Do Not Track requests. Do Not Track is a preference you can set in your web browser to inform websites and mobile applications that you do not want to be tracked. You can enable or disable Do Not Track by visiting the preferences or settings page of your web browser.

DATA SECURITY

We implement and maintain appropriate technical and organizational security measures, such as software- and hardware-based monitoring and protection, access controls, firewalls, and encryption (i.e., SSL and HTTPS) to protect the Personal Information that we collect and maintain from unauthorized access, destruction, use, modification, or disclosure. However, no security measure or modality of data transmission is 100% secure, and we are unable to guarantee the absolute security of the Personal Information we have collected from or about you.

Further, electronic communication that you send us may not be secure and we advise that you not send Personal Information such as financial information, social security numbers, or passwords through electronic communication.

LINKS TO THIRD PARTY WEBSITES AND PUBLIC FORUMS

The Website may contain links to other third-party websites or services that are not operated or controlled by TalentBurst. We are not responsible for the content or privacy and data collection practices of any non-TalentBurst websites to which we link from the Website and cannot control the content or security of such websites. We encourage you to review the privacy practices or notices posted on this third party websites for further information.

We also may make message boards, news groups, or public forums available to users on our Website, and Social Media Pages. Any information that you provide or disclose in these areas becomes public information that may be accessed by third parties and is done so at your own risk.

YOUR INFORMATION CHOICES

You have the following choices with respect to your Personal Information:

  • Unsubscribe From Newsletters and Marketing Communications. You may opt out of receiving newsletters or marketing emails from us by clicking the “unsubscribe” link included with each newsletter or provided at the bottom of each email we send. Please note that we may continue to send you notifications necessary to perform the Services.
  • Opt Out of Email Tracking. You can disable this tracking by blocking automatic loading of images in your email.
  • Correct or View Your Personal Information. You may send an email to privacy@talentburst.com to correct or view certain Personal Information of yours in our possession.
  • Opt Out of Analytics and Interest-Based Advertising. Cookies generally fall into two categories: session cookies and persistent cookies. Session cookies are temporary and expire after you close your web browser. Persistent cookies can be removed by following your web browser’s directions. To find out how to see what cookies have been set on your computer or device, and how to reject and delete the cookies, please visit: https://www.aboutcookies.org/. Please note that each web browser is different. To find information relating to your browser, visit the browser developer’s website and mobile application. If you reset your web browser to refuse all cookies or to indicate when a cookie is being sent, some features of our Website may not function properly. If you choose to opt out, we will place an “opt-out cookie” on your device. The opt-out cookie is browser specific and device specific and only last until cookies are cleared from your browser or device. The opt-out cookie will not work for essential cookies. If the cookie is removed or deleted, if you upgrade your browser or if you visit us from a different computer, you will need to return and update your preferences. By clicking on the “opt-out” links below, you will be directed to the respective third party website where your computer will be scanned to determine who maintains cookies on you. At that time, you can either choose to opt out of all interest-based advertising or you can choose to opt out of targeted advertising by selecting individual companies who maintain a cookie on your machine.

 

In general, to disable cookies and limit the collection and use of information through them, you can set your browser to refuse cookies or indicate when a cookie is being sent.

RIGHTS OF CALIFORNIA RESIDENTS

The California Consumer Privacy Act of 2018, as amended by the California Privacy Rights Act (collectively, “CCPA”) entitles California residents to certain rights with respect to their Personal Information. To the extent the CCPA applies to our processing of your Personal Information, you have the following rights:

  • Right to Access/Know. You have the right to request what Personal Information we have collected, used, disclosed, and sold about you, unless doing so proves impossible or would involve disproportionate effort. You may exercise this right only once in any twelve (12) month period.
  • Right to Deletion. You have the right to request the deletion of your Personal Information that we collect or maintain, subject to certain exceptions. For example, if we are required by law to retain the information that you are asking to be deleted, we would not be able to delete the information until we are legally permitted to delete it.
  • Right to CorrectYou have the right to correct inaccurate Personal Information that we collect or maintain.
  • Right to Opt Out of Sale/SharingYou have the right to opt out of the sale or sharing of your Personal Information to third parties. TalentBurst does not have actual knowledge that it sells or shares Personal Information of minors under the age of sixteen (16) years.
  • Right to Opt Out of Automated Decision-Making Technology. You may ask us not to use automated decision-making technology, including “profiling,” in connection with decisions related to the work opportunities and placements offered to you.
  • Right to Non-DiscriminationYou have the right to not receive discriminatory treatment if and when you exercise your privacy rights under the CCPA.
  • Right to Limit Use of Sensitive Personal InformationYou have the right to limit the use of your Sensitive Personal Information when such use goes beyond that which is necessary for providing the Services or certain other permissible purposes like fraud, customer service or quality control. Sensitive Personal Information includes Social Security number, driver’s license number, biometric information, precise geolocation, and racial and ethnic origin. However, TalentBurst does not process Sensitive Personal Information in a manner which gives rise to this right.
  • Right to Data PortabilityYou have the right to ask that we transfer the Personal Information you gave us, to you, or in certain cases, directly to another organization, in a format that is easily understandable and to the extent technically feasible, in a structured, commonly used, machine-readable format. However, you may exercise this right at no cost up to two times per calendar year.

Exercising Your Rights

If you wish to exercise your privacy rights, you may submit a request via email to privacy@talentburst.com, or by calling toll-free (855) 706-7801. To opt out of the sale/share of your information through cookies, please visit Do Not Sell or Share My Personal Information. If the browser or extension that you (or your authorized agent) are using supports Global Privacy Control (GPC) (see here for more information), you may utilize the GPC opt out preference signal to instruct us to not sell or share any of your personal information collected online. The GPC opt out preference signal will apply to the device, platform, or browser in which you utilize it. You can utilize the opt out preference signal by turning on the signal in your device, platform, or browser settings. Please note that you must opt out of each device and each browser.

For verifiable rights requests, you must provide us with your name, and we may ask for additional information such as your email address, phone number and mailing address. Failure to provide the necessary information may prevent us from processing your request, as we are required to verify your identity before processing the request. If you have requested that we correct your Personal Information, we may contact you to request additional information as to what Personal Information you believe is inaccurate.

Upon receipt of your request to exercise your rights, we will acknowledge receipt within the time-period required by applicable law and provide you with information about the next steps in the process.

Only you, or a person that you authorize to act on your behalf may make a request related to your Personal Information. If you are an authorized agent making a request on behalf of another individual, you must provide us with signed documentation showing that you are authorized to act on behalf of that individual.
